This Notice informs you how we look after your personal data when you visit our Portal at and/or submit a form to us via the Portal and tells you about your privacy rights and how the law protects you.


The Products Pending Online Licensing Portal (Portal) is operated by Products Pending (Products Pending, we, our). Products Pending is the controller and responsible for your personal data.

While we welcome the opportunity to resolve any issue you may have with our handling of your personal data, you have the right to make a complaint at any time to the Information Commissioner's Office (ICO), the UK supervisory authority for data protection issues (


Personal data means any information about an individual from which that person can be identified.

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  • Identity Data: Including first name, last name, similar identifier.

  • Contact Data: Including email address, mobile and landline telephone number.

  • Transaction Data: Including details collected from forms that you submit via our Portal.

  • Technical Data: Including internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this Portal.

  • Usage Data: Including information about how you use our Portal, products and services.

  • Marketing and Communications Data: Including your preferences in receiving marketing from us.

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users requesting a particular licence. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data) or any information about criminal convictions and offences.


Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to grant you a licence over IP). In this case, we may have to cancel a transactional arrangement you have with us but we will notify you if this is the case at the time.


We use different methods to collect data from and about you including:


  • Direct interactions. You may give us your Identity, Contact, and Transaction Data by filling in forms or by      corresponding with us by email or otherwise. This includes personal data you provide when you submit a completed form to us in regard to taking a licence over the content on the Portal.


  • Automated technologies or interactions. As you interact with our Portal, we will automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this personal data by using cookies and other similar technologies.


  • Receiving Contact, Financial and Transaction Data from providers of technical services and/or payment services; and Identity and Contact Data from publicly available sources such as Companies House and the Electoral Register.


We will only use your personal data where the law allows us to. Most commonly, we will use your personal data in the following circumstances:


  • Where we need to perform the contract we are about to enter into or have entered into with you.


  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.


  • Where we need to comply with a legal obligation.

Below describe all of the ways we plan to use your personal data, and which of the lawful bases we rely on to do so (we have also identified what our legitimate interests are where appropriate).


We may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data. Please contact us if you need details about the specific lawful ground, we are relying on to process your personal data where more than one ground has been set out in the table below.


We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to receive an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.


If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

We may use cookies for certain areas of the website on which the Portal is located. Cookies are files that store information on your hard drive or browser that means a website can recognise that you have visited the website before. You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. If you disable or refuse cookies, please note that some parts of this website may become inaccessible or not function properly.


We do not transfer your personal data outside the United Kingdom.


We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a need to know in connection with our operations. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality. But while we strive to protect your information and personal data, we cannot guarantee and do not warrant the security of any information you send to us, and when you do so it is at your own risk.


We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.


To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.


Under certain circumstances, you have rights under data protection laws in relation to your personal data to:


  • request access to your personal data;

  • request correction of your personal data;

  • request erasure of your personal data;

  • object to processing of your personal data;

  • request restriction of processing your personal data;

  • request transfer of your personal data; and

  • exercise your right to withdraw consent.


We may need to request specific information from you to help us confirm your identify and ensure your right to access your personal data (or to exercise any of your other rights). Usually, no fee will be required for you to access your personal data but we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively we could refuse to comply with your request in these circumstances.  We will keep you informed of how long it will take to respond to your request.
